1. Agreement to Terms

By accessing or using Spotter ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including visitors, registered users, and subscribers.

2. Description of Service

Spotter provides an integrated wellness platform that includes:

• Fitness Journal: Workout tracking, exercise logging, progress monitoring, and goal setting
• Nutrition Tracker: Food diary, macro tracking, water logging, and nutritional insights
• Mental Wellness: Meditation guides, mood tracking, and mindfulness practices

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

3.1 Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Age Requirement

You must be at least 13 years old to use Spotter. If you are under 18, you must have parental or guardian consent.

4. Subscriptions and Payments

4.1 Subscription Plans

Spotter offers various subscription plans with different features and pricing. By subscribing, you agree to pay the fees for your selected plan.

4.2 Billing and Renewal

• Subscriptions automatically renew unless canceled before the renewal date
• We will charge your payment method on file at the start of each billing cycle
• Prices are subject to change with 30 days' notice
• Payment processing is handled securely through Stripe

4.3 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• Refunds are provided on a case-by-case basis at our discretion
• No refunds for partial months or unused portions

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Share your account credentials with others
• Attempt to gain unauthorized access to our systems
• Upload viruses, malware, or malicious code
• Scrape, data mine, or harvest data from the Service
• Reverse engineer or attempt to extract source code
• Impersonate others or provide false information
• Harass, abuse, or harm other users
• Use automated systems (bots, scrapers) without permission

6. User Content

6.1 Your Content

You retain ownership of content you submit (workout logs, meals, notes, etc.). By using Spotter, you grant us a license to use, store, and process your content to provide the Service.

6.2 Content Responsibility

You are solely responsible for your content. We do not endorse or guarantee the accuracy of user-generated content. We reserve the right to remove content that violates these Terms.

All content, features, and functionality of the Service (including text, graphics, logos, icons, images, audio, software, and design) are owned by Spotter and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOTTER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• Injuries or health issues resulting from use of the Service
• Unauthorized access to your account or data
• Third-party content or conduct

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Spotter, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended inactivity

Upon termination, your right to use the Service ceases immediately. We may delete your data after account closure.

12. Governing Law and Disputes
